KolekciApps Terms of Service

Applications Covered by These Terms

These Terms of Service (the “Terms”, and where applicable the end user licence agreement or “EULA”) apply to the following applications published by KolekciApps LLC: FaceMagic AI and BabyScan. Each is referred to below as “the app” and together as “the service”. PDFai, WaPulse and SeenTrack have their own terms, listed at kolekciapps.com/legal.

For apps distributed through the App Store, these Terms supplement, and do not replace, Apple’s Licensed Application End User License Agreement available at apple.com/legal/internet-services/itunes/dev/stdeula. Where the two conflict, the Apple Standard EULA governs to the extent of the conflict.

1. Acceptance of Terms

By accessing or using an application covered by these Terms, you agree to be bound by them. If you do not agree, please do not use the service.

2. Description of Service

The apps covered by these Terms provide artificial intelligence-powered media generation that allows users to create images and videos from their own prompts and media.

Our services may include:

  • AI-powered image and video generation
  • Photo transformation and enhancement
  • Portrait creation and style transfer
  • AI-based creative media generation from prompts and uploaded media

The apps are entertainment and creative tools. They are not medical devices and do not provide medical, diagnostic or other professional advice.

3. User Accounts and Registration

Some features may require account registration. By creating an account, you agree to:

  • Provide accurate, current, and complete information
  • Maintain and update your information to keep it accurate
  • Maintain the confidentiality of your account credentials
  • Accept responsibility for all activities that occur under your account
  • Notify us immediately of any unauthorized use of your account

4. Acceptable Use Policy

You agree to use the service only for lawful purposes and in accordance with these Terms. You agree not to:

  • Upload images or videos of other individuals without their consent
  • Generate illegal, harmful, threatening, or abusive content
  • Use the service for fraudulent, deceptive, or malicious purposes
  • Violate any applicable laws or regulations
  • Infringe upon the rights of others, including privacy, publicity, or intellectual property rights
  • Attempt to reverse engineer, copy, or misuse our AI models or technology

5. Content and Intellectual Property

Your Content

You retain ownership of the images, videos, and prompts you upload to the app. By uploading content, you grant us a limited, temporary license to process and use the content solely for the purpose of providing the requested service.

Generated Content

You own the content generated through your use of the service, subject to these Terms. However, you acknowledge that similar or identical outputs may be generated for other users based on similar inputs.

Our Intellectual Property

All technology behind the apps, including AI models, software, algorithms, design, and branding, is owned by KolekciApps LLC or its licensors and is protected by intellectual property laws. You may not copy, distribute, modify, or create derivative works from our technology without permission.

6. Payment and Billing

The apps may offer subscription-based or credit-based access to certain features. Subscriptions and one-time purchases are billed by Apple or Google under their own terms; we do not process payments directly.

  • Subscription fees may be billed weekly, monthly or annually in advance.
  • Credits may be required for certain generation features.
  • Purchases are non-refundable except where required by applicable law or by the store’s own policies. See our Refund Policy.
  • We reserve the right to modify pricing with reasonable notice.
  • Failure to complete payment may result in suspension or termination of access.

7. Privacy and Data Protection

Our collection and use of information is governed by our Privacy Policy. By using the service, you acknowledge and agree to the data practices described there.

8. Service Availability and Modifications

We aim to provide a reliable service but cannot guarantee uninterrupted access. We reserve the right to:

  • Modify, suspend, or discontinue any part of the service
  • Update AI models and infrastructure to improve functionality
  • Perform maintenance that may temporarily affect service availability
  • Implement usage limits or restrictions when necessary

9. Disclaimers and Limitation of Liability

Service Disclaimer

The service is provided on an “as is” and “as available” basis without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free, or that generated results will be accurate.

Limitation of Liability

To the maximum extent permitted by law, KolekciApps LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service.

10. Indemnification

You agree to indemnify and hold harmless KolekciApps LLC, its owners, employees, and partners from any claims, damages, or expenses arising from your use of the service, violation of these Terms, or infringement of the rights of any third party.

11. Termination

Either party may terminate this agreement at any time.

  • By You: You may stop using the service and delete your account at any time.
  • By Us: We may suspend or terminate accounts that violate these Terms or misuse the service.
  • Effect of Termination: Upon termination, your right to access the service will end and we may delete associated data as permitted by law.

12. Governing Law

These Terms shall be governed by and interpreted in accordance with applicable international laws and regulations unless otherwise required by local jurisdiction. Mandatory consumer-protection rights in your country of residence are unaffected.

13. Changes to Terms

We may update these Terms from time to time. When we make material changes, we will update the “Last updated” date. Continued use of the service after updates constitutes acceptance of the revised Terms.

14. Severability

If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Bu Koşulların Kapsadığı Uygulamalar

Bu Kullanım Koşulları (“Koşullar” ve geçerli olduğu yerde son kullanıcı lisans sözleşmesi, “EULA”), KolekciApps LLC tarafından yayımlanan şu uygulamalar için geçerlidir: FaceMagic AI ve BabyScan. Aşağıda her biri “uygulama”, birlikte ise “hizmet” olarak anılır. PDFai, WaPulse ve SeenTrack’in kendi koşulları vardır; bunlar kolekciapps.com/legal adresinde listelenir.

App Store üzerinden dağıtılan uygulamalarda bu Koşullar, apple.com/legal/internet-services/itunes/dev/stdeula adresindeki Apple Lisanslı Uygulama Son Kullanıcı Lisans Sözleşmesini tamamlar, onun yerine geçmez. İkisi arasında çelişki olması hâlinde, çelişki kapsamında Apple Standart EULA geçerlidir.

1. Koşulların Kabulü

Bu Koşulların kapsadığı bir uygulamaya erişerek veya onu kullanarak Koşullarla bağlı olmayı kabul edersiniz. Kabul etmiyorsanız lütfen hizmeti kullanmayın.

2. Hizmetin Tanımı

Bu Koşulların kapsadığı uygulamalar, kullanıcıların kendi komutlarından ve medyalarından görsel ve video oluşturmasını sağlayan yapay zekâ destekli medya üretimi sunar.

Hizmetlerimiz şunları içerebilir:

  • Yapay zekâ destekli görsel ve video üretimi
  • Fotoğraf dönüştürme ve iyileştirme
  • Portre oluşturma ve stil aktarımı
  • Komutlardan ve yüklenen medyadan yapay zekâ ile yaratıcı içerik üretimi

Uygulamalar eğlence ve yaratıcılık araçlarıdır. Tıbbi cihaz değildir; tıbbi, tanısal veya başka bir uzman tavsiyesi sunmaz.

3. Kullanıcı Hesapları ve Kayıt

Bazı özellikler hesap oluşturmayı gerektirebilir. Hesap oluşturarak şunları kabul edersiniz:

  • Doğru, güncel ve eksiksiz bilgi vermek
  • Bilgilerinizi doğru kalacak şekilde güncel tutmak
  • Hesap bilgilerinizin gizliliğini korumak
  • Hesabınız üzerinden gerçekleşen tüm etkinliklerin sorumluluğunu üstlenmek
  • Hesabınızın yetkisiz kullanımını derhal bize bildirmek

4. Kabul Edilebilir Kullanım

Hizmeti yalnızca hukuka uygun amaçlarla ve bu Koşullara uygun olarak kullanmayı kabul edersiniz. Şunları yapmamayı kabul edersiniz:

  • Başkalarının görsellerini veya videolarını rızaları olmadan yüklemek
  • Yasa dışı, zararlı, tehdit edici veya saldırgan içerik üretmek
  • Hizmeti dolandırıcılık, aldatma veya kötü niyetli amaçlarla kullanmak
  • Geçerli yasa ve düzenlemeleri ihlal etmek
  • Mahremiyet, kişilik ve fikri mülkiyet hakları dahil başkalarının haklarını ihlal etmek
  • Yapay zekâ modellerimize veya teknolojimize tersine mühendislik yapmaya, bunları kopyalamaya ya da kötüye kullanmaya çalışmak

5. İçerik ve Fikri Mülkiyet

İçeriğiniz

Uygulamaya yüklediğiniz görsellerin, videoların ve komutların mülkiyeti sizde kalır. İçerik yükleyerek, yalnızca talep ettiğiniz hizmeti sunmak amacıyla bu içeriği işlememiz ve kullanmamız için bize sınırlı ve geçici bir lisans vermiş olursunuz.

Üretilen İçerik

Hizmeti kullanarak ürettiğiniz içerik, bu Koşullara tabi olmak üzere size aittir. Bununla birlikte, benzer girdilerle başka kullanıcılar için benzer veya aynı çıktıların üretilebileceğini kabul edersiniz.

Fikri Mülkiyetimiz

Uygulamaların ardındaki tüm teknoloji — yapay zekâ modelleri, yazılım, algoritmalar, tasarım ve marka dahil — KolekciApps LLC’ye veya lisans verenlerine aittir ve fikri mülkiyet yasalarıyla korunur. İznimiz olmadan teknolojimizi kopyalayamaz, dağıtamaz, değiştiremez veya türev çalışmalar oluşturamazsınız.

6. Ödeme ve Faturalama

Uygulamalar belirli özellikler için abonelik veya kredi tabanlı erişim sunabilir. Abonelikler ve tek seferlik satın alımlar, kendi koşulları çerçevesinde Apple veya Google tarafından faturalandırılır; ödemeleri doğrudan biz işlemeyiz.

  • Abonelik ücretleri haftalık, aylık veya yıllık olarak peşin tahsil edilebilir.
  • Bazı üretim özellikleri için kredi gerekebilir.
  • Geçerli yasanın veya mağaza politikalarının gerektirdiği hâller dışında satın alımlar iade edilmez. Bkz. İade Politikamız.
  • Makul bildirimde bulunarak fiyatları değiştirme hakkımız saklıdır.
  • Ödemenin tamamlanmaması erişimin askıya alınmasına veya sonlandırılmasına yol açabilir.

7. Gizlilik ve Veri Koruma

Bilgileri toplamamız ve kullanmamız Gizlilik Politikamıza tabidir. Hizmeti kullanarak orada açıklanan veri uygulamalarını kabul etmiş olursunuz.

8. Hizmetin Sürekliliği ve Değişiklikler

Güvenilir bir hizmet sunmayı hedefleriz ancak kesintisiz erişimi garanti edemeyiz. Şu haklarımız saklıdır:

  • Hizmetin herhangi bir bölümünü değiştirmek, askıya almak veya sonlandırmak
  • İşlevselliği geliştirmek için yapay zekâ modellerini ve altyapıyı güncellemek
  • Hizmetin erişilebilirliğini geçici olarak etkileyebilecek bakım çalışmaları yapmak
  • Gerektiğinde kullanım sınırları veya kısıtlamaları uygulamak

9. Sorumluluk Reddi ve Sınırlandırılması

Hizmet Sorumluluk Reddi

Hizmet, hiçbir türde garanti verilmeksizin “olduğu gibi” ve “mevcut olduğu şekilde” sunulur. Hizmetin kesintisiz, güvenli veya hatasız olacağını ya da üretilen sonuçların doğru olacağını garanti etmeyiz.

Sorumluluğun Sınırlandırılması

Yasanın izin verdiği azami ölçüde KolekciApps LLC; hizmeti kullanmanızdan kaynaklanan dolaylı, arızi, özel, sonuçsal veya cezai zararlardan sorumlu değildir.

10. Tazminat

Hizmeti kullanmanızdan, bu Koşulları ihlal etmenizden veya üçüncü kişilerin haklarını ihlal etmenizden doğan talep, zarar ve masraflara karşı KolekciApps LLC’yi, sahiplerini, çalışanlarını ve iş ortaklarını tazmin etmeyi ve zarardan korumayı kabul edersiniz.

11. Fesih

Taraflardan her biri bu sözleşmeyi istediği zaman feshedebilir.

  • Sizin tarafınızdan: Hizmeti kullanmayı bırakabilir ve hesabınızı istediğiniz zaman silebilirsiniz.
  • Bizim tarafımızdan: Bu Koşulları ihlal eden veya hizmeti kötüye kullanan hesapları askıya alabilir ya da kapatabiliriz.
  • Feshin sonucu: Fesih hâlinde hizmete erişim hakkınız sona erer; ilgili verileri yasanın izin verdiği ölçüde silebiliriz.

12. Uygulanacak Hukuk

Yerel mevzuatın aksini gerektirmediği hâllerde bu Koşullar, geçerli uluslararası hukuk ve düzenlemelere göre yorumlanır ve uygulanır. İkamet ettiğiniz ülkedeki zorunlu tüketici koruma haklarınız saklıdır.

13. Koşullardaki Değişiklikler

Bu Koşulları zaman zaman güncelleyebiliriz. Önemli değişiklik yaptığımızda “Son güncelleme” tarihini yenileriz. Güncellemelerden sonra hizmeti kullanmaya devam etmeniz, gözden geçirilmiş Koşulları kabul ettiğiniz anlamına gelir.

14. Bölünebilirlik

Bu Koşulların herhangi bir hükmünün geçersiz veya uygulanamaz olduğu tespit edilirse, kalan hükümler tam olarak yürürlükte kalır.
